These general terms and conditions apply to the purchase of goods and other services on www.rubiomonocoat.dk.

These terms and conditions apply to consumer purchases on our website shop.rubiomonocoat.dk. By ordering products on shop.rubiomonocoat.dk, you confirm that you are not purchasing products as a business customer or for the purpose of resale. If you wish to purchase as a business customer, please contact our B2B department at service@rubiomonocoat.dk.

2. Scope of Application

These terms and conditions are applicable to consumer purchases on our website www.rubiomonocoat.dk.

All agreements are concluded in Danish, and Rubio Monocoat Nordic ApS reserves the right to refuse sales intended for resale, regardless of advertising, signage, stock availability, etc.

3. Ordering Process & Formation of the Sales Contract

A binding agreement between you and Rubio Monocoat Denmark ApS is only concluded once you receive an order confirmation by email. Until you receive an order confirmation, Rubio Monocoat Denmark ApS is entitled to cancel your order in whole or in part, for example due to pricing and text errors or out-of-stock items, and if this happens, you will of course be notified by email.

Once you have placed an order on our website, you will receive an email stating which goods and services you have ordered. This email is solely an electronic receipt confirming that we have received your order.

4. Shipping

Rubio Monocoat Nordic ApS delivers only to addresses in Denmark, excluding Greenland, the Faroe Islands, and non-bridged islands.

We undertake to deliver the ordered goods within 5 days after the order is placed, unless another delivery date has been expressly agreed. If we are unable to deliver within 5 days, you will be informed in writing and a new delivery date will be provided within a reasonable time. If this new delivery period is also exceeded, you have the right to cancel the order.

We reserve the right to make partial deliveries of the ordered goods in the event of temporary unavailability or delivery delays. You will be informed if a partial delivery is made.

If delivery is delayed because you unreasonably refuse to accept the goods or have not collected them within a reasonable period, we have the right to cancel the agreement. In such case, the amount you have already paid will be refunded, however with a deduction of compensation of up to 20% for the reasonable administrative costs incurred.

Goods delivered by freight carrier are generally delivered curbside, on solid ground and at street level. Packages sent via parcel distributor are delivered to your door or to a selected pickup point.

The shipping cost for your order depends on the types of goods ordered. The shipping amount will be shown in the cart as items are added. Shipping prices are based on delivery from our webshop warehouse or directly from our suppliers.

You must inspect your goods immediately upon receiving the shipment. If there is visible damage to the shipment, you must note this on the delivery note when signing for receipt. If you discover that the goods are damaged, you must notify us immediately – and no later than within 2 business days – as failure to do so may result in loss of the right to make a claim for transport damage.

Reservations are made for sold-out items and delayed delivery times from our suppliers.

5. Prices

All prices are stated in Danish kroner (DKK) including VAT.

Our prices are continuously updated. The price stated in your order confirmation sent by email is the price you must pay. The prices stated for individual products on our website are exclusive of delivery costs. You can always view delivery costs in the cart before placing an order.

6. Payment Methods

Payment can be made using the following payment methods: 

  • Credit/Debit Cards: Visa, Mastercard, Maestro, American Express
  • Digital Wallets: Shop Pay, Apple Pay, Google Pay, PayPal

When paying with Mastercard Debit or Visa Electron (which are debit cards), the payment will be reserved on your account in accordance with the terms of your card until we either withdraw or reject the payment.

No fee is charged for payment by credit card, and the amount is withdrawn when the goods or partial delivery are dispatched.

If multiple items have been ordered in a partial order and one or more of the items are not delivered immediately, we will only withdraw payment for those items when all items in the partial order have been dispatched.

7. Right of Withdrawal

There is a 14-day right of withdrawal for purchases made on www.rubiomonocoat.dk. The withdrawal period expires 14 days after the day on which the goods are received. If you have purchased several items in one order, you may choose to withdraw from parts of the purchase.

The condition for exercising the right of withdrawal is that you notify Rubio Monocoat Nordic ApS within 14 days of receiving the goods that you wish to withdraw from your purchase. The notification must be given by email or via our contact form, and you must clearly state that you wish to exercise your right of withdrawal. 

If the ordered goods are custom-made according to your specifications, have a clearly personalized character, or for health and hygiene reasons are not suitable for return once the seal has been broken, there is no right of withdrawal for such goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

You may normally examine the goods in the same way as you would in a physical store, but you may not use them. If you have used the goods in a way that is not permitted in a store, and we cannot resell them or cannot resell them at full price, we are entitled to deduct the loss in value from the amount to be refunded. If the goods no longer have any commercial value, the purchase price will not be refunded.

You should also ensure that the goods are properly packaged when returning them. You bear the risk for the package/goods until we receive them. Therefore, keep the postal receipt and any track and trace number.

The goods must be returned without undue delay and no later than 14 days after the day you have notified us of your withdrawal.

When you withdraw, we refund the payments received from you, excluding any delivery costs. We will refund the amount as soon as possible and no later than 14 days after we have received the returned goods. We will carry out such refund using the same means of payment as you used for the original transaction, unless you have expressly requested otherwise.

8. Right to Complain (Warranty Claims)

Rubio Monocoat Nordic ApS encourages you to inspect the delivered goods immediately upon receipt. If any defects or deficiencies are discovered, please notify us immediately.

In accordance with the Danish Sale of Goods Act, you as a consumer are entitled to a 24-month right to complain on all goods (for goods with limited durability, the right to complain is limited to the shelf life period normally expected for the goods in question). If the goods unexpectedly break during the complaint period, the right to complain means that you may have the goods repaired, replaced, refunded, or receive a price reduction depending on the specific situation, provided of course that the complaint is justified. In the event of a justified complaint, the defect rules of the Danish Sale of Goods Act may apply.

In accordance with the Sale of Goods Act, you are obligated to react within a reasonable time after the defect has been discovered. In this regard, 2 months is always considered a reasonable time.

The right to complain does not apply if the delivered goods have been exposed to abnormal conditions or otherwise used or handled incorrectly or abnormally, in violation of the accompanying instructions for use or instructions on the packaging.

If you wish to complain to us about a defect, we ask you to provide as detailed a description as possible of the issue via our complaint form [hyperlink]. Please attach photos if possible, as this makes it easier for us to identify the defect and minimizes processing time.

10. Reservations

Rubio Monocoat Nordic ApS reserves the right for any errors in text and prices, errors in illustrations/photos, stock errors, system errors, sold-out goods, backorders, delays, changes in exchange rates, or customers’ incorrect orders.

Rubio Monocoat Nordic ApS is also not responsible for any failure or delay in fulfilling its obligations if this is caused by force majeure. In the event of force majeure, you will be informed, and both parties will have the option to cancel the agreement without this entitling either party to compensation.

11. Complaint Procedure

If you wish to complain about your purchase, please contact service@rubiomonocoat.dk. If we are unable to reach an agreement, you may file a complaint with the relevant complaints board.

A complaint about a product or service purchased from us may be submitted to Nævnenes Hus, Toldboden 2, 8800 Viborg. You can submit a complaint to Nævnenes Hus via www.naevneneshus.dk.

12. Changes

Rubio Monocoat Nordic ApS is entitled at any time to make changes to these terms and conditions.
